2. CONCLUSION OF THE CONTRACT AND DELIVERY OF ITEMS
2.1 By placing an order, you declare that you are acting exclusively for private purposes.

We draw your attention to the fact that we are exempt from delivering the ordered goods if we ourselves have placed the order for the goods in due form but have not been supplied in due time by our suppliers. Exemption from delivery also requires that the unavailability of the goods is not attributable to us, that we have not expressly agreed to bear the supply risk and that we have informed you of the unavailability of the goods within as fast as we can. When the above conditions are met, the order is canceled and we will refund the amounts you have already paid.
2.8 Our obligation to deliver is limited to goods which we have in stock or which we have ordered from our suppliers. In the event of delivery of dealshouseworld.com Partner items , it is appropriate to take into consideration, in addition to our own stock, the stock of goods from the dealshouseworld.com Partner . We deliver exclusively to mainland France, Corsica and Monaco.
2.9 We reserve the right not to accept an order or to cancel an order if it has been placed using software, robots, web crawlers, web spiders or any automated system or scripted behavior and using third party services to place an order on your behalf.
3. PRICES, DELIVERY COSTS AND EXPRESS DELIVERY
3.1 The products are invoiced on the basis of the prices indicated in the offer at the time of the order. The prices indicated are the final prices, all taxes included at the legal rate in force. The merchandise remains our property until full payment of the sale price. In the event of sale of dealshouseworld.com Partner items , the merchandise remains the property of the Bon-Deal Partner until full payment of the sale price. 3.3 dealshouseworld.com offers delivery costs from thirty-four euros (€34.00) of purchase, excluding express delivery costs. Orders below an amount of thirty-four euros (€34.00) generate delivery costs of four euros and ninety-five cents (€4.95), these including VAT. Fees are related to costs resulting from the size of the order, and, among other things,
shipping, processing and other services. Costs are invoiced and collected by dealshouseworld.com . These additional charges will be specified during the payment process and will be added to the total amount payable.
3.4 However, depending on where the item you ordered will be shipped, long-distance delivery costs of €4.95, including VAT, may apply. We will inform you before your order is finalized if long distance delivery charges apply to the item you have selected. Long distance delivery charges are levied and collected by dealshouseworld.com . If you decide to return an item for which you have been charged a long distance delivery fee, we will reimburse you for these long distance delivery fees only in the situation where the entire order concerned is returned. These stipulations will apply within the limits of applicable legislation.
3.5 Once delivery has been made, you are required to check immediately whether it is complete and whether the goods are damaged. Any complaints must be sent to the transport company without delay. 4. PAYMENT
4.1 We accept the following payment methods: bank transfer, credit card, and PayPal secure payment system. Depending on each order, however, we reserve the right not to offer certain payment methods or to offer others. We only accept payments from bank accounts held within the European Union (EU). All costs related to your payment are your responsibility.
4.2 If purchased by credit card, your account will be debited on the day your order is shipped.
4.3 You agree to receive invoices and credit notes only in electronic form.
4.4 With our Try First, Pay Later offer, we offer the following deferred payment methods: Your credit card is debited either after the announcement of a return of goods, or after the arrival of the returned goods, otherwise eighteen (18) days after the order. We grant a deadline extension of fourteen (14) days from dispatch of the goods. In this case, you will be informed by email of the specific deadline. In this email you will also find a link allowing you to choose the payment method you wish (art. 4.1). For each order, we reserve the right not to offer Try First, Pay Later or to limit it to the one of the payment methods mentioned.
5. USE OF DISCOUNT VOUCHERS
5.1 Discount vouchers are only distributed free of charge as part of promotional actions. They have an expiry date, cannot be purchased and are not transferable.
5.2 Discount coupons are valid only for the period indicated and can be used only once in a single order. Certain products may be excluded from the benefit of discount coupons. A discount coupon cannot be used to purchase gift vouchers. A minimum purchase amount can be specified for each discount voucher.
5.3 To be able to use a discount voucher, the order value must be at least equal to the discount amount. The difference between the amount of the discount voucher and the price of your order can be paid by any payment method offered. The credit materialized by the reduction voucher is not refundable and does not produce interest. In the event of total or partial return of the goods, the part of the price paid by discount voucher will not be refunded to you.
5.4 To apply a voucher to an order, you must enter the voucher code before sending the order. The application of discount vouchers to orders already sent is excluded. Unless otherwise stated, it is not possible to combine multiple coupons.
5.5 If you used a discount voucher when making your purchase, we reserve the right to charge you the undiscounted price of the goods when, due to partial withdrawal, the total amount of the remaining order is less than or equal to to the value of the discount voucher.
6. USE OF GIFT VOUCHERS
6.1 Gift vouchers are discount vouchers that you can purchase. Gift vouchers can only be used for the purchase of dealshouseworld.com items, dealshouseworld.com Zircle items and dealshouseworld.com Partner items , the purchase of other gift vouchers being excluded. You can pay any difference between the amount of the gift voucher and the price of your order by any payment method offered.
6.2 To be able to use the credit corresponding to a gift voucher, you must enter the code appearing on the gift voucher before sending your order. The credit materialized by the gift vouchers does not bear interest and cannot be refunded. You can credit the value of a gift voucher to your customer account or consult the balance of your customer account by accessing in the “my gift vouchers and credits” section on dealshouseworld.com
7. LEGAL RIGHT OF WITHDRAWAL WHEN PURCHASING A dealshouseworld ITEM
When purchasing dealshouseworld.com items you benefit from a legal right of withdrawal. Please note that for any return of goods, you can use the return label which is attached to your order or which you can edit at from your customer account. If you do not have a printer, or have difficulty downloading the return label or need a new label, you can contact our customer service, contact details below. 7.1 Information relating to the right of withdrawal: You have the right to withdraw from this contract without giving any reason within fourteen (14) days. The withdrawal period expires fourteen (14) days after the day on which you yourself, or a third party other than the carrier and designated by you, takes physical possession of the goods or the last goods in the event of partial delivery. (i) you must send us your withdrawal declaration before the expiry of the said period;
(ii) the products must not have been used, opened or damaged;
(iii) Products must be returned undamaged and unused in their original packaging. If applicable, the packaging must retain the original seal.
7.2 Exception to the application of the right of withdrawal
In accordance with article L. 221-28 paragraph 5 of the Consumer Code, the legal right of withdrawal is excluded in the case of sealed articles which have been opened after their delivery and which cannot be returned for health or hygiene reasons.
7.3 Effects of withdrawal
In the event of a valid withdrawal, we will reimburse all payments received from you, including delivery costs (with the exception of Express delivery costs) without delay and at the latest within fourteen (14) days from from the day we became aware of your declaration of withdrawal. We will reimburse using the same payment method you used, unless we expressly agree on a different payment method. The refund is at no cost to you. We reserve the right to defer reimbursement until we have received the goods or until you have provided proof of dispatch of the goods, whichever date is the earlier of these events. You must contact us return or return the goods to us without delay and, in any event, at the latest within fourteen (14) days from the day on which you communicate your declaration of withdrawal to us.
This deadline is met if you ship the goods before the deadline expires. We cover the return costs if you use the return label provided to you for a return within French territory. In all other cases, return costs are your responsibility.
You must bear the loss of value of the returned merchandise if this loss of value is due to handling other than that necessary to ensure the nature, characteristics and correct functioning of the merchandise.

8.1 Information relating to the right of withdrawal:

9. 90-DAY RIGHT OF RETURN
9.1 Without prejudice to the legal right of withdrawal from which you benefit, we grant you a right of return extended to one hundred (90) days from receipt of the goods. Under this right of return, you can cancel your order even after the legal withdrawal period of fourteen (90) days has expired (see the information above concerning the exercise of the legal right of withdrawal). The right of return is exercised, in the case of dealshouseworld or articles from dealshouseworld Zircle, by returning the goods to us, or, in the case of a dealshouseworld item , by returning it to the dealshouseworld , within a period of one hundred (90) days from receipt of the goods. The legal provisions regarding withdrawal only apply until the statutory withdrawal period has expired. The right of return does not affect your rights in terms of legal guarantee and conformity from which you benefit without restriction. The right of return is excluded in the event of the purchase of gift vouchers.
9.2 The one hundred (90) day right of return will not apply to sealed products which have been opened after delivery or for which the seal has been damaged.
9.3 The return period is respected if you ship the goods within said period. This right of return is only granted to you on the condition that you have tried on the goods only to check the size, as you would do in a store. The returned item must be intact, in perfect resalable condition and in its original packaging. Any item damaged or whose original packaging is damaged will not be refunded or exchanged.
9.4 For any return of dealshouseworld items or items from dealshouseworld Zircle, you can use the return label which is attached to your order or which can be edited from your customer account. If you do not have a printer, or have difficulty downloading the return label or need a new label, you can contact our customer service. 9.5 For any return of dealshouseworld Partner items , you can use the return label attached to your order. You will also find these contact details in the information on the right of withdrawal which we attach as a PDF document to our order confirmations. 9.6
You will be responsible for replacing the original packaging if it is lost. In this situation, you may choose to accept a partial refund due to the drop in value of the item returned without original packaging, the amount of which we will communicate to you, or to recover the products at your expense. In the latter case, if you refuse this delivery, we reserve the right to retain the item and the specified amount for partial reimbursement due to the drop in value of the returned item.
10. REFUND
Any possible reimbursement from us will be made to the account you used to make the payment. In the event of payment by bank transfer, the amount is transferred to the account from which the transfer was made. If you paid by PayPal or credit card, the amount will be refunded to the bank account linked to this payment method. If paying by gift voucher, we will credit your customer account with the corresponding amount.
11. REVIEW MODERATION
In accordance with the provisions of Article 6, I, 7° of Law No. 2004-575 of June 21, 2004 for confidence in the digital economy, the agreement is not subject to a general obligation to monitor comments posted on the dealshouseworld platform .
However, dealshouseworld carries out moderation of the opinions published on the Bon-Deal platform in order to ensure their legality and probity.
To do this, dealshouseworld moderates said opinions
(i) before their publication;
(ii) then, if they have been the subject of a publication, when they have been reported by a user.
In this context, dealshouseworld reserves the right not to publish opinions and/or to delete them at any time if these comments
(i) infringe the applicable legal and regulatory provisions, and in particular, constitute manifestly illicit content (p. e.g. insulting, denigrating, violent, racist, infringing);
(ii) do not relate to a purchasing experience on the dealshouseworld platform ;
(iii) invades a person's privacy;
(iv) are not understandable;
(v) encourage the purchase of products from a competing website;
(vi) were inserted via an automatic process; (vii) relate to a complaint that has been handled by dealshouseworld
customer service ; (viii) are likely to incur liability in any way ; (ix) refer to another website and/or contain a hyperlink to another website; or (x) are considered inappropriate by law .

13. LEGAL GUARANTEES
Sales made through the dealshouseworld.com site are subject to the conditions of the legal guarantee of conformity provided for in articles L.217-4 et seq. of the consumer code as well as the legal guarantee against hidden defects set out in articles 1641 and following of the Civil Code. You can exercise these guarantees by sending your request to dealshouseworld SE, Valeska-Gert-Straße 5, 10243 Berlin, Germany or to the e-mail address or fax number indicated in article 11 as well as, when the item covered by one of the said guarantees is a dealshouseworld Partner item, to the dealshouseworld partner concerned.
As part of the legal guarantee of conformity, we remind you that you:
(i) have a period of two (2) years from the delivery of the item you ordered to take action against us or against against the dealshouseworld partner when the item concerned is a dealshouseworld Partner item ;
(ii) can choose between repairing or replacing the item you have ordered, subject to the cost conditions mentioned in Article L. 217-9 of the Consumer Code. In the event that repair and replacement of the goods are impossible, you can return the goods and have the price refunded or keep the goods and have part of the price refunded;
(iii) be exempt from providing proof of the existence of the defect in the Partenaire dealshouseworld item , during the two (2) years following the delivery of said item. This deadline is extended to one (1) year for dealshouseworldZircle items because they are second-hand items.
The legal guarantee of conformity applies independently of any commercial guarantee which may be granted to you by us or the dealshouseworld partner concerned.
Regarding the articles from dealshouseworld Zircle, dealshouseworld would like to remind you that they correspond to second-hand articles. Therefore, the usual signs of use which can be reasonably expected from a second-hand item cannot constitute a lack of conformity. Thus, for the marks of use mentioned in the description of the article concerned, the legal guarantee of conformity cannot be implemented.
In addition, you can decide to implement the guarantee against hidden defects in accordance with the provisions of article 1641 of the civil code. In this situation, you can choose between canceling the sale or reducing the sale price in accordance with 1644 of the civil code.
Article L. 217-4 of the Consumer Code
The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility.
Article L. 217-5 of the Consumer Code
The good complies with the contract: 1/ If it is suitable for the use usually expected of a similar good and, where applicable: - if it corresponds to the description given by the seller and possesses the qualities that the latter presented to the buyer in the form of a sample or model; - if it presents the qualities that a buyer can legitimately expect having regard to the public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling; 2/ Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Article L. 217-12 of the Consumer Code
Action resulting from lack of conformity is prescribed two (2) years from delivery of the goods.
Article L. 217-16 of the Consumer Code
When the buyer requests from the seller, during the course of the commercial guarantee which was granted to him during the acquisition or repair of movable property, a restoration covered by the warranty, any period of downtime of at least seven days is added to the remaining warranty period. This period runs from the buyer's request for intervention or the making available for repair of the goods in question, if this making available is subsequent to the request for intervention.
Article 1641 of the Civil Code
The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the buyer would not have acquired it. , or would have given only a lower price, if he had known them.
Article 1648 paragraph 1 of the Civil Code
Action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.

15. AMICABLE SETTLEMENT OF DISPUTES
Under article L. 612-1 of the Consumer Code “Every consumer has the right to have free recourse to a consumer mediator with a view to amicably resolving the dispute between him and a professional. ". This covers disputes of a contractual nature, relating to the execution of a contract of sale or supply of services, between a consumer and a professional. In the event of difficulties, we invite you to contact our after-sales service first (see . point 11). If your problem is not resolved, you can resort to the services of a mediator within one (1) year from receipt of your request by the after-sales service, with a view to settling the dispute out of court. .
In order to make its catalog even more attractive, to provide a larger assortment and better availability of products to its customers, dealshouseworld launched the partner program: the dealshouseworld“marketplace” .
Specifics of the partner program
1.1. Description of the “partner program” service
The partner program is a platform integrated into the website which allows professional partner sellers (i) to offer new products for sale to consumers, at a firm price, (ii) to collect the sale price of the products sold in this way. that (iii) to provide after-sales service for said items.
In addition, the professional seller partner can also opt for logistics and marketing services.
As part of the partner program, dealshouseworld acts as co-seller of the partner professional seller's products.
To benefit from the partner program, the partner professional seller must pay remuneration to dealshouseworld.
1.2. Payment terms and financial transaction management method
The consumer must pay the purchase price of a product from a professional partner seller directly to dealshouseworld. To do this, the consumer must choose the payment method of their choice available on the dealshouseworld website , namely: bank transfer, credit card, and PayPal secure payment system.
1.3. Guarantees
